Terms of Service

These Terms of Service apply when you visit stepsparklearning.co.uk or buy or download a resource from StepSpark Learning. Please read them before placing an order. Nothing in these terms limits any rights you have under applicable consumer law.

1. About us

2. Our products

We sell digital educational resources, normally supplied as downloadable PDF files. We do not sell or ship physical products unless a product page expressly says otherwise. Each product page sets out the main features of the resource, including its intended use, file format and page count.

Colours and page appearance can vary slightly between screens, printers, paper and print settings. You are responsible for checking that you have suitable software and equipment to open and, if required, print the stated file format.

3. Orders and formation of the contract

You can review and correct your order before submitting it. When you place an order, you make an offer to buy the selected product on these terms. A contract is formed when we accept your order and send an order confirmation or make the digital content available, whichever happens first.

We may decline or cancel an order before delivery where, for example, payment is not authorised, the product is unavailable, the price or description contains an obvious error, or we reasonably suspect fraud or misuse. If we cancel an order after taking payment, we will refund the amount paid.

4. Prices and payment

Prices are shown in pounds sterling unless stated otherwise. The price payable is the price displayed at checkout when you place the order, including any taxes that the checkout identifies as applicable. Payment is processed using the payment methods offered at checkout. We do not receive your full payment-card details.

5. Digital delivery

Digital products are normally made available electronically after successful payment, through the checkout confirmation and/or an email sent to the address provided with the order. Please provide an accurate email address and check your spam or junk folder if a delivery email does not arrive.

If you cannot access a purchased file, contact us with your order number and the email address used for the order. We will take reasonable steps to restore access or provide the file again.

6. Cancellation, refunds and your statutory rights

Consumers normally have a 14-day right to cancel a distance contract. For digital content supplied immediately, you will be asked to expressly consent to supply beginning during that period and to acknowledge that, once supply begins, you lose the right to cancel where the law permits this.

Digital content must be as described, of satisfactory quality and fit for any particular purpose that you made known to us and that we accepted. If a resource is faulty, materially different from its description or unavailable as promised, contact us. Depending on the circumstances and your legal rights, we may repair or replace the file, reduce the price or provide a refund.

Further details are set out in our Refund policy. That policy forms part of these terms. Your statutory consumer rights are not affected.

7. Licence to use the resources

When you purchase or lawfully download a StepSpark Learning resource, you receive a limited, non-exclusive, non-transferable licence to use it for personal and educational purposes.

The purchaser may save the file on their own devices and print reasonable copies for their own household or for learners they personally teach or support. You must not resell, sublicense, publish, upload, distribute or share the digital file or editable copies with other people, organisations, online groups, shared drives, marketplaces or websites. You must not remove ownership notices or present the resource as your own work.

If a product page includes different licence terms, those specific terms take priority for that product.

8. Intellectual property

All intellectual property rights in the website and StepSpark Learning resources, including text, illustrations, layouts, downloads and branding, belong to StepSpark Learning or its licensors. Buying a resource does not transfer ownership of those rights. You may use the content only as permitted by these terms or by applicable law.

9. Educational-use information

Our resources provide general educational practice and are not a substitute for professional educational, medical, therapeutic or diagnostic advice. Adults are responsible for selecting activities that suit the learner and for supervising their use where appropriate.

References to curriculum topics, classroom uses or phonics-screening-style practice describe the intended learning context only. Unless a product page expressly states otherwise, resources are independently created and are not endorsed by a government department, examination body, school or other institution.

10. Website use

You must not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorised access, scrape it in a way that disrupts the service, or use the website or resources for unlawful purposes.

We try to keep the website accurate and available but may update, suspend or withdraw content when reasonably necessary. We are not responsible for brief interruptions caused by maintenance, security issues, network failures or events outside our reasonable control.

11. Third-party services and links

Our store is hosted by Shopify and may use third-party providers for payments, downloads and other store functions. Those providers process information under their own terms and privacy notices where applicable. Links to third-party websites are provided for convenience; we do not control their content.

12. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was made.

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to digital content.

Our products are supplied for private and educational use. If you use them for a commercial purpose outside the licence above, we are not responsible for business losses, including loss of profit, revenue, opportunity, data or goodwill, to the extent permitted by law.

13. Privacy

We handle personal information as described in our Privacy policy. By using the website, you acknowledge that Shopify and other service providers may process information needed to operate the store and fulfil orders.

14. Changes to these terms

We may update these terms to reflect changes to the store, our products or applicable law. The version shown when you place an order will apply to that purchase unless a change is required by law. The latest version and its update date will remain available on this page.

15. General terms

If any part of these terms is found to be unlawful or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not waive that right. No person other than you and us has a right to enforce these terms.

16. Governing law and disputes

These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you keep any mandatory protections provided by the law of the part of the United Kingdom where you live, and you may bring proceedings in the courts available to you under applicable law.

Please contact us first if you have a concern so we can try to resolve it. You can also obtain independent consumer advice from Citizens Advice or the relevant consumer service where you live.
